Amazon Prime: Federal Court of Justice Reviews Legality of Price Increase

The Federal Court of Justice (BGH) in Karlsruhe is examining the unilateral price hikes for the subscription service Amazon Prime this Thursday. The consumer protection organization Verbraucherzentrale Nordrhein-Westfalen had filed the lawsuit because the e-commerce giant raised subscription fees in 2022 without the explicit consent of subscribers.

Background of the Amazon Prime Legal Dispute

In 2022, Amazon adjusted the fees for its German Prime service. The annual subscription increased from 69.00 euros to 89.90 euros. For monthly billing, the price rose from 7.99 euros to 8.99 euros. Amazon cited rising operating costs as the reason for the move.

While the company notified customers about the change, it did not obtain explicit consent for the higher rates. According to Verbraucherzentrale NRW, several million customers in Germany were affected by this measure.

Lower Courts Declared Price Adjustment Clause Invalid

Consumer advocates have already secured victories in lower courts. Both the Düsseldorf Regional Court and the Düsseldorf Higher Regional Court ruled that the price adjustment clause used by Amazon was unlawful. The company appealed these judgments to the Federal Court of Justice.

The BGH’s Third Civil Senate is now hearing the case. It remains unclear whether Germany’s highest civil court will deliver a ruling on the day of the hearing or announce its decision at a later date.

Significance for Consumers and Next Steps

If the Federal Court of Justice upholds the Düsseldorf courts’ rulings and overturns the clause for good, the decision would have a significant precedent-setting effect on existing contracts. Upholding the legal view of the lower courts would establish the legal basis for affected subscribers to reclaim the price difference paid since 2022.

Prime members do not need to take any action yet, but should wait for the BGH’s upcoming decision. It is advisable to hold on to older invoices and proof of Prime fees paid since 2022 to substantiate potential refund claims once a legally binding verdict is issued.
