III ZR 205\/25). Germany&#8217;s highest civil court thereby upheld rulings by lower courts, strengthening the position of millions of Prime subscribers in Germany who can now reclaim the price surcharges they paid.<\/p>\n<p>The move was already anticipated when the <a href=\"https:\/\/netguide.io\/news\/de\/2026\/10\/01\/amazon-prime-bundesgerichtshof-verhandelt-uber-rechtmasigkeit-der-preiserhohung\/\" rel=\"nofollow noopener\">Federal Court of Justice heard arguments on the legality of the price increase<\/a>. Amazon had unilaterally raised Prime membership fees in September 2022: the monthly rate increased at the time from 7.99 to 8.99 euros, while the annual fee jumped from 69 to 89.90 euros. The Prime Student tier was also affected by the markup. The corporation justified the hike by citing general cost increases driven by inflation and pointed to clauses in its General Terms and Conditions.<\/p><div id=\"netgu-3829641292\" Verbraucherzentrale NRW successfully sued against this practice. The BGH followed the consumer advocates&#8217; reasoning: the clauses used were incomplete and ambiguously phrased. Subscribers could not clearly discern what specific rights they held in the event of a price adjustment\u2014such as whether objecting would keep the contract active under the old conditions or inevitably result in cancellation. Furthermore, the terms stipulated that a lack of response would be considered automatic consent.<\/p>\n<p>Following the court&#8217;s determination, the subscription increase back then lacks any legal basis. An estimated 17 million customers in Germany use the service, which includes retail delivery benefits as well as access to streaming content.<\/p>\n<h2>Two Paths to a Refund: Class Action Recommended<\/h2>\n<p>Affected customers now have the option to demand the difference between the original and the increased amount. Depending on the chosen subscription tier and payment period, claims have now accumulated to more than 60 euros. Customers have two options to seek reimbursement:<\/p>\n<ul>\n<li><strong>Registering in the claims registry:<\/strong> Verbraucherzentrale NRW is pursuing a model declaratory action (class action) against Amazon before the Higher Regional Court of Hamm. Registering in the corresponding registry at the Federal Office of Justice is free of charge and carries no financial litigation risk. This action covers claims retroactively back to the start of the price hike in September 2022.<\/li>\n<li><strong>Individual reimbursement claims:<\/strong> Customers can assert their claims for overpaid fees directly against Amazon. However, the standard civil statute of limitations of three years applies here, meaning claims from the earliest months may have already expired.<\/li>\n<\/ul>\n<h2>Amazon&#8217;s Response for Legacy Contracts<\/h2>\n<p>Initial operational consequences are already emerging for existing customers. Amazon announced that it would temporarily roll back fees to the previous level for members whose subscriptions were started before September 15, 2022, and have not been modified since. Affected customers are to be notified prior to their next billing cycle.
